1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of CloudRunner ("the App"), developed and published by n8shift studio ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms.

2. Description of the App

CloudRunner is a free-to-play mobile endless runner game. The App includes optional blockchain-based features powered by the Solana network, including:

• Connecting a Solana-compatible wallet (e.g. Phantom, Solflare, Backpack)
• Minting Founders Edition NFTs (digital collectibles on the Solana blockchain)
• Uploading scores to the global leaderboard (requires NFT ownership)

Use of wallet and NFT features is entirely optional. The core gameplay does not require a wallet or any purchase.

3. Eligibility

The App is available to users of all ages. Blockchain features involving financial transactions (such as NFT minting) are intended for users who are of legal age in their jurisdiction to engage in such transactions.

4. User Responsibilities

You are responsible for:

• Maintaining the security of your own wallet and private keys
• Any transactions you authorize through your wallet
• Ensuring you have sufficient funds (SOL) for NFT minting
• Using the App in compliance with applicable laws

5. Digital Assets & NFTs

Founders Edition NFTs are digital collectibles minted on the Solana blockchain. By minting an NFT, you understand that:

• All blockchain transactions are final and irreversible
• NFTs are subject to Solana network fees and conditions
• We do not guarantee any future value, utility, or resale potential of NFTs
• NFT ownership is recorded on the Solana blockchain and is outside our control once minted

6. Intellectual Property

All game content, artwork, music, code, and branding associated with CloudRunner and n8shift studio are owned by us or our licensors, except as noted below. You may not reproduce, distribute, or create derivative works from any proprietary portion of the App without our written permission.

Certain third-party assets incorporated into the App are licensed under Creative Commons Zero (CC0) or comparable public domain dedications. Such assets are not claimed as proprietary intellectual property of n8shift studio, and all rights (or absence thereof) with respect to those assets remain as established by their original creators and applicable license terms. Nothing in these Terms shall be construed as restricting any rights granted under a CC0 or public domain license.

7. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or tamper with the App
• Use bots, scripts, or exploits to manipulate gameplay or leaderboard scores
• Attempt to interfere with the App's servers or infrastructure
• Use the App for any illegal or unauthorized purpose

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Use of blockchain features is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, n8shift studio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of digital assets, wallet compromise, or failed transactions on the Solana network.

10. Third-Party Services

The App interacts with third-party wallet applications (e.g. Phantom, Solflare, Backpack), the Solana blockchain network, and cloud-hosted services for leaderboard functionality. We are not responsible for the availability, security, or performance of these third-party services.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will update the "Last updated" date at the top of this page.

12. Termination

We reserve the right to restrict or terminate access to the App at any time, for any reason, without prior notice.
